1. Acceptance
By accessing or using OwnBudget ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
OwnBudget is a personal finance application that stores all financial data locally on your device. We do not access, transmit, or store your financial information on our servers. OwnBudget does not provide financial, investment, tax, or legal advice. Do not make financial decisions based solely on information presented in the app.
3. Your Data and Responsibility
You own your data entirely. Because all data is stored locally on your device, you are solely responsible for maintaining backups of your data. OwnBudget is not responsible for data loss resulting from device failure, browser data clearing, operating system updates, or any other cause outside our control. We strongly recommend using the encrypted vault export feature regularly.
4. Subscription and Payment
Pro features require a paid subscription processed by Paddle.com, our payment provider. By subscribing you authorize recurring charges to your payment method. Monthly subscriptions renew monthly; annual subscriptions renew annually. You may cancel at any time; cancellation takes effect at the end of the current billing period. All payments are handled by Paddle under their terms and privacy policy.
5. Refund Policy
Monthly subscribers: no refunds; cancel anytime. Annual subscribers: full refund within 30 days of purchase; prorated refund at our discretion after 30 days. Contact hello@ownbudget.app for refund requests.
6. Acceptable Use
You agree not to: reverse-engineer, decompile, or disassemble the Service; resell or sublicense the Service; use the Service for any unlawful purpose; attempt to gain unauthorized access to any part of the Service or its infrastructure.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OWNBUDGET AND ITS OWNERS, OPERATORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).
9. Indemnification
You agree to indemnify, defend, and hold harmless OwnBudget and its owners, operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
10. Dispute Resolution
Any dispute arising from these Terms or your use of the Service shall be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in Maricopa County, Arizona. You waive any right to a jury trial or to participate in a class action lawsuit.
11. Governing Law
These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict of law provisions.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notice. Continued use of the Service after changes constitutes acceptance of the new Terms.
